How is AI being used in the legal system?
Thanks for asking. ChatGPT has been invading all walks of life in recent months, and that even includes the justice system.
In late March 2023, a Pakistani judge consulted the chatbot before granting bail to a 13-year-old boy who stood accused of kidnapping an attempting to rape a nine-year-old.
According to Pakistan Observer, the judge asked Chechi PT the following initial question.
Can a juvenile suspect in Pakistan who is 13 years old be granted bail after arrest?
The chatbot responded, Under the Juvenile Justice System Act 2018, according to Section 12, the court can grant bail on certain conditions.
A discussion then ensued on how this option could be interpreted when taking into account certain other laws.
The judge included ChatGPT's responses in his judgement and stated how impressed he was And while it was a first in Pakistan, back in February The Guardian reported on a Colombian judge who also used ChatGPT when considering a case.
That was to determine whether an autistic child's health insurance should cover 100% of his treatment costs.
The cases have led to hope that AI could make legal systems around the world more efficient, but there's been a lot of criticism and scepticism too.
Are there any other examples aside from ChatGPT?
Actually, a technology called predictive justice has been around for quite some time now.
The term refers to the use of data analysis and machine learning to estimate the outcome of a legal dispute based on previous cases.
This form of legal tech was used for the first time in California in 2006.
The potential benefits include reducing uncertainty and improving decision-making for lawyers and judges.
Predictive justice can even be used in some domains to quantify the amount of damages, pensions or indemnities awarded by courts.
What are the possible risks then? As you may know by now, ChatGPT isn't perfect.
It's certainly reliable a lot of the time but sometimes provides different answers to the same question. or fabricates information completely.
Its answers are always delivered in a confident tone too. which sometimes misleads those asking it questions.
When it comes to predictive justice, the reliability of the data and algorithms used can be an issue.
There are also ethical and legal implications of using predictions to influence judicial decisions.
After all, this could violate the presumption of innocence, the right to a fair trial, or the principle of equality before the law.
A notorious example of these problems is the compass system, which has been shown to be unreliable and racially biased in predicting reoffending rates for criminal defendants in the United States.
Closer to home, a 2022 House of Lords report suggested that the unregulated use of AI in the UK justice system could lead to miscarriages of justice, It cited the Durham Police Constabulary's Heart AI tool, as well as the Home Office's sham marriage algorithm.
