NPR Legal Affairs correspondent Nina Totenberg noted that three federal judges have already ruled the administration's order "blatantly unconstitutional." The administration is now attempting to curb the power of district court judges to issue nationwide injunctions. This case, according to law professor Samuel Bray, arrives at a time when the justices are already "slogging through" an emergency docket, potentially complicating their summer recess.

Legislative Strains in the House

House Speaker Mike Johnson is currently navigating internal party divisions to pass what President Trump calls his "big beautiful bill." The package includes controversial measures such as extending 2017 tax cuts, eliminating taxes on tips and overtime, and implementing cuts to Medicaid and the food assistance program (SNAP).

Speaker Johnson describes himself as a "neutral empire" trying to reconcile the competing needs of "red state folks" and "blue state folks" within his conference. Tensions are particularly high regarding the cap on state and local tax (SALT) deductions, which is a priority for members from high-tax states. Adding to the complexity, the Congressional Budget Office estimates that the proposed Medicaid changes could result in "at least 8.6 million people" losing coverage.
